3. Categories of Personal Data Collected
We may collect and process identification and contact data, including name, email address, telephone number and location data provided by the candidate; CVs, résumés, cover letters, application details, professional profile information, employment history, education, qualifications, language skills, compensation expectations, availability, interview notes and correspondence; technical and usage data, including IP address, browser data, device information, logs, cookies and security-related metadata; and any other information voluntarily submitted by the candidate through the Website or in the course of the recruitment process. Candidates are requested not to include special categories of personal data unless such disclosure is strictly necessary and legally justified.

4. Purposes and Legal Basis of Processing
We process personal data for the following purposes and on the following legal bases:
(a) to receive, review and manage applications, assess candidate suitability, communicate with candidates and present candidate profiles to relevant clients and prospective employers in connection with current recruitment, staffing, agency and/or fulfillment processes, on the basis of Article 6(1)(b) GDPR, namely processing necessary in order to take steps at the request of the data subject prior to entering into a contract or engagement;
(b) to maintain limited internal records, ensure platform and service security, prevent misuse, improve our services, and establish, exercise or defend legal claims, on the basis of Article 6(1)(f) GDPR and, where applicable, Article 6(1)(c) GDPR;
(c) to retain candidate profiles in our talent pool and contact candidates regarding future employment, contractor or project opportunities beyond the current recruitment process, only where the candidate has provided separate consent pursuant to Article 6(1)(a) GDPR;
(d) to send newsletters or marketing communications where permitted by applicable law and subject to the relevant legal basis.
Where special categories of personal data are included in a CV or otherwise submitted, we will process such data only to the extent permitted by Article 9 GDPR and applicable law.

5. Data Sharing and Recipients
We may share personal data, where necessary and proportionate, with:
(a) our authorized employees, partners and external collaborators involved in the relevant recruitment, staffing or fulfillment process;
(b) IT, hosting, security, legal, accounting and administrative service providers acting under appropriate contractual safeguards;
(c) clients and prospective employers to whom a candidate may be presented in the context of a current recruitment process or, where separately consented to, future opportunities; and
(d) competent public, judicial, regulatory or supervisory authorities where disclosure is required by law or necessary for the establishment, exercise or defense of legal claims.
Clients and prospective employers receiving candidate data act as independent data controllers in respect of their own subsequent processing.

6. International Data Transfers
Candidate personal data may be transferred within the European Economic Area (“EEA”). Where candidate data is transferred to a recipient outside the EEA, such transfer shall take place only where one of the lawful transfer mechanisms under Chapter V GDPR applies, including:
(a) an adequacy decision adopted by the European Commission;
(b) appropriate safeguards, including the European Commission’s Standard Contractual Clauses and, where required, supplementary measures; or
(c) in exceptional cases only, an applicable derogation under Article 49 GDPR, including the candidate’s explicit consent after having been informed of the possible risks of the proposed transfer due to the absence of an adequacy decision and appropriate safeguards.
We do not rely on Article 49 GDPR derogations as a general or routine transfer mechanism.

7. Data Retention
Candidate data relating to a current recruitment process shall be retained for up to twenty-four (24) months from the closure of the relevant process or the last meaningful interaction with the candidate, unless a longer retention period is necessary for compliance with legal obligations or for the establishment, exercise or defense of legal claims.
Where a candidate has separately consented to inclusion in our talent pool for future opportunities, the relevant candidate profile may be retained for up to forty-eight (48) months from the date of consent or the candidate’s last meaningful interaction with us, whichever is later, after which the data shall be deleted, anonymized or the consent shall be refreshed.
If consent is withdrawn, the relevant data shall be removed from the talent pool without undue delay, subject to any strictly necessary residual retention for legal compliance or claims handling.

8. Data Security
Data is hosted securely within the EU (Germany) under SSL encryption and regular backup systems. Only authorized personnel have access to personal data. Email transmissions are encrypted, and spam/captcha filters are used on forms.

9. Candidate Rights under GDPR
You have the right to:
•    Access your personal data
•    Request rectification or erasure (“right to be forgotten”)
•    Restrict or object to processing
•    Withdraw consent at any time
•    Data portability (receive your data in a structured format)

Where processing is based on consent, candidates may withdraw such consent at any time as easily as it was given. Withdrawal shall not affect the lawfulness of processing carried out before such withdrawal. Where processing is based on Article 6(1)(f) GDPR, candidates also have the right to object to such processing in accordance with Article 21 GDPR.

10. Automated Processing & Profiling
No automated decision-making or profiling takes place.

11. Marketing & Communication 
We may send updates, invitations, or news to: 
•    Individuals who have subscribed via our forms (consent)
•    Existing clients and candidates (soft opt-in) Each message includes an unsubscribe link and a clear option to withdraw consent.

By submitting their CV, application or profile through the Website, candidates confirm that they have read this Privacy Policy and request POD Professional Solutions to assess their application and, where relevant to the current recruitment process, to present their profile to relevant clients or prospective employers in accordance with this Privacy Policy.
Where the Website offers a separate, optional consent mechanism for inclusion in a talent pool or for future opportunities beyond the current recruitment process, such additional processing shall take place only on the basis of the candidate’s freely given, specific, informed and unambiguous consent.
